The ordinance would not prohibit someone with a concealed carry permit from securing their weapon in their car if they are parked at a recreation facility. The amendment passed, and the bill has been sent to the Senate, where it has been referred to the Senate Judiciary II Committee.

The bill was amended to exempt defendants who are deemed indigent and are qualified to receive court-appointed counsel, and it was also amended to require that counties can only charge the lesser of the cost of providing the service or the authorized jail fee in G.S. 7A-313. It was signed by the governor on June 27, 2011.

Comments:S756 passed the Senate with a vote of 33-16. The bill, sponsored by Sen. Debbie Clary (Cleveland), amends current pretrial release procedures in several ways. First, S756 eliminates unsecured appearance bonds. It also expands how electronic monitoring may be used and requires the execution of at least a $1,000 secured appearance bond if electronic monitoring is imposed as a condition of pretrial release. Current law only allows electronic monitoring to be used with house arrest. S756 further provides that a person may be placed in a pretrial program only if the execution of a secured bond is a condition of pretrial release and only if a judicial official finds that at least 72 hours has elapsed from the date and time on the defendant’s release order. The bill specifically states that a pretrial release program shall not contact or otherwise attempt to gain access to a defendant prior to the expiration of the 72-hour period. The NCACC voiced concerns that these changes in pretrial programs have to potential to put additional burdens on already over-capacity jails. S756 has been referred to House Judiciary Subcommittee C. It will be eligible for action during the 2012 Short Session.

Comments:This bill appropriates $10 million for 2011‑12 to provide grants for gang prevention and improved gang reporting. This would accomplish an NCACC legislative goal to maintain funding for gang prevention programs.
