Comments:This bill would amend the N.C. Constitution and provide a constitutional right to government public records and open meetings. The bill provides that the amendment would be voted on in the November 2012 general election. The bill has been removed from the House calendar several times as several legislators are arguing against a constitutional amendment and instead are suggesting that any changes to existing laws be made through revising the General Statutes. The House did amend the bill to allow a unit of government to charge a "reasonable" fee for the costs incurred when copying or compiling records to satisfy a request. The bill was re-referred to the House Rules Committee on March 29. It is uncertain if the House has the 72 votes needed to pass a constitutional amendment.

Comments:This bill would establish a 16-member Legislative Study Commission on Public‑Private Partnerships. The NCACC would be among several groups that would be consulted by the commission during its deliberations. The Commission would be charged with studying "issues related to Public‑Private Partnerships (PPPs), including examination of the appropriate authority for State, regional, and local government units to engage in PPPs for public capital projects through a regulatory framework. As part of its study, the Commission may study infrastructure banks and any other relevant issues it deems appropriate." The commission would report its recommendations prior to the 2012 Short Session. The bill passed the House on June 7.

Counties that pursue this option must create and maintain a notice book that includes a hard copy of all electronic notices. This bill would accomplish an NCACC legislative goal to "Authorize electronic notice of public hearings and other legal notices." According to estimates obtained by the NCACC, the bill could save counties more than $2 million per year. The bill failed in the House Government Committee, but has been withdrawn from that committee and sent to the House Rules Committee, where it may be converted to a local bill.

Comments:This bill makes significant changes to zoning laws and specifically overturns an N.C. Court of Appeals case that upheld a Pasquotank County zoning ordinance. The bill increases the statute of limitations to challenge the validity of any zoning or unified development ordinance from two months to one year. In addition to increasing the statute of limitations, the bill provides that the statute of limitations shall begin to run when a party first has standing to challenge the ordinance. Thus, the action could potentially accrue years after the zoning ordinance passes, when a new owner comes into possession of property. This change could significantly open the door to challenges to zoning ordinances. In addition, Section 5 of H806 specifically overturns the N.C. Court of Appeals decision in the case of Tonter Investments, Inc. v. Pasquotank County. The bill limits counties' ability to manage single-family residential use on large lots. It also prohibits county adoption of an ordinance that would require lots greater than 10 acres to have frontage on a public road or county approved private road, or be served by public water or sewer lines. The bill passed third reading and is now in the Senate.

Comments:This bill makes numerous changes to the state's annexation laws, including several of the components of the Association's legislative goal for annexation reform. Specifically, the bill requires cities to provide water and sewer services within three and a half years (the Association's goal sought a three-year limit). H845 requires municipalities to provide the installation of water and sewer connections to annexed residents at no charge if at least 50 percent of the property owners in the area to be annexed sign up for the service within 65 days of receiving notice of the annexation. It also provides a petition process by which citizens who live in the area to be annexed can protest the annexation. If 60 percent of the property owners within the annexed area sign the petition and return it to the county board of elections within 130 days of the adoption of the resolution, the annexation is stopped and the municipality must wait three years before it can try to annex the area again. The municipality must reimburse the board of elections for its costs.

This bill allows a local government to protect the identity of those making certain 911 calls by allowing the content of the call to be released "in the form of a written transcript or altered voice reproduction." Previous law considered the actual recording of the phone call a public record. Passage of this bill accomplished an NCACC legislative goal.

Comments:This bill applies statewide a local law passed in 2010 that states that copies of subscriber e-mail lists maintained by local governments are not required to be provided to someone requesting a copy. Instead, the local government can opt to make the lists available for public inspection in either printed or electronic format - or both, if the government chooses. The NCACC adopted a goal to "seek legislation to protect the privacy of e-mail notification and distribution lists of citizens who have requested electronic communication with their local governments." The Senate passed the bill as a local act that added Carteret County and the City of Greenville to those jurisdictions already covered. The House changed the bill to make it statewide, and the Senate concurred with the House changes on April 20.

Comments:This bill would require city and county governing boards to designate a website to publicize its schedule of meetings, notices of meetings, Agendas and minutes of meeting, including the minutes of closed sessions "to the extent that those minutes have been made available to the public." The publisher of the website could not charge the board to post the notices and could not charge a fee to the public to access the information. A city or county could designate its own website as the site to post the notices. The bill also would require a city or county governing body to conduct a review each quarter of all of the closed session meetings it had held within the previous three years to determine whether the minutes from those closed sessions can "now be disclosed to the public." The bill also requires a governing body to create an inventory and status report of all "minutes, tape recordings or other records of the closed session" each time it goes into closed session.

The commission would study "issues relating to records preservation standards, procedures, and techniques." The bill would also establish June 1 as the deadline to apply for a property tax exemption or exclusion. Finally, the bill directs "taxpayers required to make monthly prepayments of sales and use taxes pursuant to G.S. 105‑164.16(b2)" to use the nine-digit zip codes of the purchaser when reporting sales. The bill passed the Senate and will be considered by the House during the 2012 Short Session.

Comments:The proposed legislation details many of the Association’s legislative goals on annexation, including: requiring the development of joint utility service plans for urbanizing areas; requiring cities to reimburse counties for the loss of sales tax due to an annexation; increasing the degree of urbanization required to annex property; requiring the direct provision of municipal water and sewer services to customers within two years of an annexation; providing that counties have the option of continuing to provide utilities to annexed areas; setting the effective date for involuntary annexations to be June 30 following the date of adoption or final Resolution of an appeal; prohibiting municipalities from annexing across county boundaries without prior consent of the Board of Commissioners of the affected county (in an instance where a municipality has already annexed across county lines, further annexation cannot occur without consent of the affected county); and prohibiting municipal involuntary annexation or regulation of farm or forestry activities within a voluntary agricultural district or conservation district. The bill would require a referendum on any involuntary annexation.
